Lubbers Group offers a wide range of transport and logistics services to both private and business customers. The Lubbers Group consists of several private limited companies (B.V.s), each applying its own general terms and conditions. Below you will find the applicable terms and conditions.

LUBBERS TRANSPORT GROUP B.V. (LUBBERS ROAD TRANSPORT)

The General Terms and Conditions of Lubbers Road Transport apply to all offers made by Lubbers Road Transport, agreements concluded by Lubbers Road Transport, and all legal and factual acts performed in execution thereof. A copy of these terms and conditions can be downloaded free of charge HERE and will also be sent free of charge upon request. The applicability of any other terms and conditions is hereby expressly rejected.

 

CONTAINER RENTAL; OEG CONTAINERS

When Lubbers rents OEG containers, the General Terms and Conditions of OEG Offshore Ltd apply back-to-back to the agreement you enter into with Lubbers. A copy of these terms and conditions can be downloaded free of charge HERE.

The Hirer is hereby deemed the Principal and OEG Offshore is deemed Lubbers, mutatis mutandis. These terms and conditions will also be provided free of charge upon request. The applicability of any other terms and conditions is hereby expressly rejected.

 

LUBBERS GLOBAL FREIGHT B.V.

All offers made by Lubbers Global Freight, all agreements concluded, and all factual and legal acts performed in execution thereof are subject to the following industry-standard terms and conditions. A copy of these terms and conditions can be downloaded free of charge below and will also be provided free of charge upon first request. The applicability of any other terms and conditions is hereby expressly rejected.

  • The General Transport Conditions Act 2002 (AVC), latest version, apply to every agreement for the carriage of goods by road, where the place of receipt of the goods and the place designated for delivery, as specified in the agreement, are located within the borders of the Netherlands.
  • The provisions of the CMR Convention apply to every agreement for the carriage of goods by road when the place of receipt of the goods and the place designated for delivery, as specified in the agreement, are located in two different countries, regardless of the place of residence and nationality of the parties. The AVC 2002 also applies to agreements governed by the provisions of the CMR Convention.
  • The Dutch Forwarding Conditions (FENEX), as filed with the Registry of the District Courts of Rotterdam and Amsterdam on 1 May 2018, apply to every agreement for the carriage of goods, as well as all activities performed by the freight forwarder, such as storage, distribution, customs clearance, insurance, repacking, weighing, marking, order picking, invoicing, etc.

 

LUBBERS PROJECTS

The General Terms and Conditions of Lubbers Projects apply to all offers made by Lubbers Projects, agreements concluded, and all legal and factual acts performed in execution thereof. LUBBERS@WORK B.V.

 

General terms and conditions

The General Terms and Conditions of NBBU, as filed with the Dutch Chamber of Commerce in Amsterdam, apply to all offers made by Lubbers@Work, agreements concluded, and all legal and factual acts performed in execution thereof. A copy of these terms and conditions can be downloaded free of charge HERE and will also be sent free of charge upon request.

Payment terms

All agreements with Lubbers@Work are subject to the payment terms of Transport en Logistiek Nederland (TLN), as filed with the Registry of the District Court of The Hague.

Collective labour agreement

Lubber@Work is a member of the NBBU (Nederlandse Bond van Bemiddelings- en Uitzendondernemingen). The NBBU collective labour agreement determines the rights and obligations of temporary agency workers and therefore also determines how Lubber@Work can operate with its Client. The parties acknowledge that the employment relationship between Lubbers@Work and the temporary workers it deploys is governed by the NBBU Collective Labour Agreement for Temporary Workers, or any successor or replacement collective labour agreement for temporary workers.

Standards and quality certifications

All Lubbers@Work services are certified according to:

– NEN 44001 standard; a national standard that sets requirements for temporary employment agencies and contractors (employment agencies, payroll companies, and subcontractors);

– VCU (Veiligheid en Gezondheid Checklist Uitzendbureaus) certificate. VCU is supplemented by the SSVV (Stichting Samenwerking Veiligheid).

Depending on the nature of Lubbers’ services, the following general terms and conditions are effective and apply to these services.

All services provided by Lubbers are carried out by Lubbers Transport Group B.V. or its affiliated companies: Lubbers Logistics Group B.V., Lubbers Projects & Services B.V., Lubbers Global Freight B.V., Lubbers Benelux B.V., Lubbers Rigmoves & Pipelines Services B.V. and Lubbers@work B.V. (jointly: “Lubbers”). The following general terms and conditions apply to all services carried out by Lubbers:

ROAD TRANSPORT

  • to all national (the Netherlands) transport of goods by road by Lubbers: General Transport Conditions (AVC), as filed with the Registry of the Court in Amsterdam and Rotterdam, the Netherlands;
  • to all cross-border road transport of goods by Lubbers: Convention on the Contract for International Carriage of Goods by Road (CMR), as supplemented by the AVC;
  • to all tower crane activities and vertical transport (lifting and hoisting operations): Standard Terms and Conditions of the Vertical Transport Association (VVT), as filed with the Registry of the Court in Amsterdam, Rotterdam and Middelburg, the Netherlands.

GLOBAL FREIGHT

  • to all cross-border road transport by Lubbers: Convention on the Contract for International Carriage of Goods by Road (CMR), as supplemented by the AVC;
  • for all storage and physical distribution (PD) activities: Dutch Forwarding Conditions, as filed by FENEX with the Registry of the Court in Amsterdam, Arnhem, Breda and Rotterdam, the Netherlands.

PROJECT & SERVICES

RIGMOVES

  • to all national (the Netherlands) transport of goods by road: General Transport Conditions (AVC), as filed with the Registry of the Court in Amsterdam and Rotterdam, the Netherlands;
  • to all cross-border transportation: Convention on the Contract for International Carriage of Goods by Road (CMR), as supplemented by the AVC;
  • for all tower crane activities and vertical transport (lifting and hoisting operations): Standard Terms and Conditions of the Vertical Transport Association (VVT), as filed with the Registry of the Court in Amsterdam and Rotterdam, the Netherlands;
  • for all assembly work: General Conditions for Commercial Removals (AVB), as filed with the Registry of the Court in Amsterdam and Rotterdam, the Netherlands.

PIPELINE LOGISTICS

  • to all national (the Netherlands) transport: General Transport Conditions (AVC), as filed with the Registry of the Court in Amsterdam and Rotterdam;
  • to all cross-border transportation: Convention on the Contract for International Carriage of Goods by Road (CMR), as supplemented by the AVC;
  • for all storage and physical distribution (PD) activities: Dutch Forwarding Conditions, as filed by FENEX with the Registry of the Court in Amsterdam, Arnhem, Breda and Rotterdam, the Netherlands;
  • on all tower crane activities and vertical transport (lifting and hoisting operations): Standard Terms and Conditions of the Vertical Transport Association (VVT), as filed with the Registry of the Court in Amsterdam, Rotterdam and Middelburg, the Netherlands;
  • on all exceptional transport: General Terms and Conditions for Exceptional Transport (AVET), as filed with the Registry of the Court in Amsterdam and Rotterdam, the Netherlands.

  • on all rental of offshore containers and baskets: the General Terms and Conditions of OEG Offshore Ltd.

LUBBERS@WORK

  • to all services: NBBU – collective agreement for temporary workers between the Landelijke Belangenvereniging and De Nederlandse Bond van Bemiddelings- en Uitzendondernemingen (NBBU), the Netherlands;
  • to all services: the NNBU General Terms and Conditions, as filed with the Dutch Chamber of Commerce in Amsterdam;
  • all services are certified on NEN 44001 standard: a national standard that sets out requirements for temporary work businesses and contractors of work (employment agencies, payroll firms and subcontractors);
  • and to all services: VCU (Safety and Health Checklist for Employment Agencies) certificate. VCU is supplemented by the SSVV (The Safety Cooperation Foundation).

Lubbers will provide its services in accordance with the payment conditions of Transport en Logistiek Nederland General Conditions of Payment (TLN), as filed with the Registry of the Court in The Hague, the Netherlands. These TLN payment conditions apply for all services carried out by Lubbers, and the underlying agreements or contracts.

All the above terms and conditions may change or be updated from time to time. The latest version of these terms and conditions will govern any future usage of our services. On your request we will forward you a copy of the relevant version(s) of these terms and conditions, free of charge. By actual usage of any service of Lubbers, you enter into an agreement with Lubbers and similarly you agree to the abovementioned terms. It is deemed declared that you have then read these general conditions and have accepted these as such.

Unless otherwise specifically agreed in writing, Lubbers undertakes services in accordance with these general conditions and accordingly all offers or tenders of services are made subject to the same.
